Inheritance in Hungary and Europe

The aim of the course

To transmit and put in a comparative context a knowledge base about inheritance procedures including the Hungarian and several other European systems as examples. The course is going to approach the institution of succession mainly from a procedural law aspect but it is inevitably going to deal with the substantive law and the international private law aspects as well.

Outline of the course

  1. The institution and definition of inheritance (by legal right or by will) and the procedures of inheritance (probate proceedings), historical background in Hungary and in Europe
  2. The system of probate proceedings in Hungary
  3. The chapter on inheritance law of the renewed Code of Civil Law
  4. The European succession regulation I.: objective, effect, jurisdiction (system of legal authority) and the case of applicable laws
  5. The European succession regulation II.: the interpretation of a will, contract of inheritance, authorities involved in the proceedings (courts, notaries public, administrative bodies), the institution of the executor of the will and administrator of the inheritance
  6. Documents in inheritance proceedings (notarial documents, court agreements, notarial warrants); European inheritance certificate
  7. The influence of the European inheritance regulation on the rules of Hungarian probate proceedings
  8. Transfer of legacy assets in the United Kingdom (the English and the Scottish system of inheritance)
  9. Inheritance in the Netherlands: the role of notaries public in acquiring the inheritance (probate)
  10. The German succession proceedings: separating Erbrecht – Erbscheins-Verfahren – Nachlassverfahren. Institutions taking part in the proceedings (the authority and are of jurisdiction of the Nachlassgericht) and personnel. The role of Germany in outlining the European inheritance regulation (inventing the German Notarial Institute)
  11. An outlook on the rules of the Austrian succession proceeding
  12. Inheritance in Italy
